COOKIE PRIVACY POLICY

The purpose of this policy is to explain what cookies are, which ones are used on the Site, and how visitors can make informed decisions regarding their management.

This website uses cookies, including third-party cookies, to provide services and information in line with users’ expectations.

Bisiach&Carrù, the Data Controller, ensures the security, confidentiality, and protection of the personal data it handles at every stage of the processing. The personal data collected is used in compliance with GDPR 679/2016.

1. WHAT COOKIES ARE AND WHICH COOKIES ARE USED ON THIS SITE

Cookies are small text strings that websites visited by the user send to their terminal (usually to the browser), where they are stored and then retransmitted to the same websites during the user’s subsequent visits. While browsing a site, the user may also receive cookies on their terminal that are sent from different websites or web servers (so-called “third parties”), which may contain certain elements (such as images, maps, sounds, specific links to pages of other domains) present on the site being visited.

Cookies, which are typically found in large numbers in users’ browsers and sometimes with a significant persistence over time, are used for various purposes: performing computer authentication, session tracking, storing information about specific configurations regarding users accessing the server, and so on.

To properly regulate these tools, it is necessary to distinguish them, since there are no technical characteristics that differentiate them based solely on their intended purposes. This is also the approach taken by the legislator, who, in accordance with the provisions of Directive 2009/136/EC, introduced the requirement to obtain users’ prior and informed consent for the installation of cookies used for purposes other than purely technical ones (see Art. 1, paragraph 5, letter a) of Legislative Decree No. 69 of May 28, 2012, which amended Art. 122 of the Privacy Code).

In this regard, and for the purposes of this document, two main categories are identified: “technical” cookies and “profiling” cookies.

a. Technical Cookies

The site uses first-party technical cookies (session, functionality/persistent cookies, and in some cases analytics cookies in aggregated and anonymous form) and possibly third-party technical cookies.

Technical cookies are used solely to “carry out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide that service.”

They are not used for additional purposes and are typically installed directly by the website owner or manager. They can be divided into:

  • Browsing or session cookies, which ensure normal navigation and use of the website (allowing, for example, purchases to be made or authentication to access restricted areas);

  • Analytics cookies, which are treated as technical cookies when used directly by the site manager to collect information in aggregated and anonymous form about the number of users and how they visit the website;

  • Functionality cookies, which allow the user to navigate based on a set of selected criteria (such as language or products selected for purchase) in order to improve the service provided.

The installation of such cookies does not require users’ prior consent. However, it is mandatory to provide information in accordance with Regulation (EU) 2016/679, which the site manager, if using only these tools, may provide in the manner deemed most appropriate.

It is, however, possible to block the installation of technical cookies using the methods indicated in paragraph 3 below.

The Data Controller advises users that blocking or later deleting technical cookies may result in partial or total limitations in accessing the site, using its features, enabling or disabling certain functions, or receiving specific services.

Legal Basis for Processing

The use of technical cookies is a processing activity carried out in the legitimate interest of the Data Controller.

b. Profiling Cookies

This site does not use first-party profiling cookies, but it may use third-party profiling cookies.

Profiling cookies are aimed at creating user profiles and are used to send advertising messages aligned with the preferences expressed by the user during web browsing. Due to the potentially significant impact these tools can have on users’ privacy, European and Italian regulations require that users be adequately informed about their use and provide valid consent.

The storage of information on a subscriber’s or user’s terminal device or access to already stored information is permitted only if the subscriber or user has given their consent after being properly informed.

It is possible to block the installation of third-party profiling cookies using the methods indicated in paragraph 3 below.

Involved Parties: Publishers and “Third Parties”

Another important element in correctly defining this subject is the identification of the party involved. In other words, it is necessary to consider whether the cookies are installed on the user’s terminal by the same manager of the website the user is visiting (referred to as the “publisher”) or by a different website that installs cookies through the former (so-called “third parties”).

Based on findings from public consultations, it is deemed necessary that this distinction between the two parties be properly considered in order to correctly identify their respective roles and responsibilities, particularly regarding the provision of information and the acquisition of users’ online consent.

There are multiple reasons why the publisher cannot be held responsible for providing information and obtaining consent for cookies installed by third parties on its website. Therefore, the publisher disclaims any and all responsibility for any requests and/or provision of personal data to third-party websites.

Based on these premises, Bisiach&Carrù informs users that this site uses third-party cookies (LinkedIn).

2. WHO IS REQUIRED TO PROVIDE INFORMATION AND REQUEST COOKIE CONSENT

According to the FAQs published by the Italian Data Protection Authority (Garante per la protezione dei dati personali), the following are required to provide information and request consent for the use of cookies:

  • The owner of the website who installs profiling cookies. As previously stated, this site does not use first-party profiling cookies.

  • For third-party cookies installed through the site, the obligation to provide information and obtain consent lies with the third parties. However, the website owner, acting as a technical intermediary between users and these third parties, must include updated links in the “extended” cookie policy to the privacy policies and consent forms of those third parties.

3. HOW TO DISABLE COOKIES

a. Through browser settings

Users can choose whether or not to accept cookies by adjusting their internet browser settings. Most browsers allow users to manage (view, enable, disable, and delete) cookies through the settings menu.

Furthermore, if you delete all cookies from your browser, technical cookies may also be removed, which could erase previously saved preferences or items in your cart.
